تتعدد المطالب التربوية العالقة في لبنان منذ سنوات، وسط الأزمات المتتالية التي أفرزت تأثيرات سلبية على القطاع التعليمي بشكل عام. وفي هذا السياق، برزت زيارة وفد اتحاد المؤسسات التربوية الخاصة إلى قصر بعبدا يوم الجمعة الفائت، برئاسة الأب يوسف نصر، رئيس الأمانة العامة للمدارس الكاثوليكية، حيث التقى الوفد الرئيس اللبناني جوزف عون.
من أبرز المطالب التي تم طرحها خلال اللقاء كان موضوع مجلس الإشراف على صندوق التعويضات لأفراد الهيئة التعليمية في القطاع الخاص. هذا المجلس عالق في أدراج مجلس الوزراء منذ شهور، حيث لم يتم البت فيه بعد. فما هو هذا الصندوق، وما دور هذا المجلس؟ وكيف يؤثر ذلك على أوضاع المعلمين في لبنان؟ ولماذا يبقى هذا الموضوع عالقًا حتى الآن؟
في حديثه مع صحيفة “النهار”، أوضح الأب يوسف نصر أن “مجلس الإشراف”، أو كما يُسمى المجلس الإداري الأصلي، عالق في مرسوم أمام مجلس الوزراء منذ شباط 2024. وهذا يعني أن أكثر من عام مرّ دون اتخاذ أي قرار حاسم بشأنه، الأمر الذي كان محط نقاش مع الرئيس عون في اللقاء الأخير.
وأشار نصر إلى أن الحكومة السابقة، برئاسة الرئيس نجيب ميقاتي، لم تبتّ في هذا المرسوم لأسباب خاصة، رغم أن وزير التربية السابق عباس الحلبي كان قد قدم المرسوم إلى الحكومة وأحالها لدراسته. إلا أن الأمور بقيت معلقة.
وتابع نصر قائلاً إن المجلس الحالي الذي يشرف على الصندوق أصبح “عاطلًا من العمل”. فقرارات هذا المجلس لا يمكن اتخاذها إلا بالإجماع، لكن بسبب غياب بعض الأعضاء المستمر، أصبح المجلس مشلولًا منذ عام 2019. ولذلك، شدد على ضرورة تعيين مجلس إداري أصيل أو مجلس إشراف يعمل بفعالية لتحسين أوضاع الكادر التعليمي.
وأكد نصر أن الوفد التربوي طالب الرئيس عون بالاستعجال في هذا الملف، بالإضافة إلى العديد من الملفات التربوية الأخرى العالقة، مشيرًا إلى أن أهمية هذا المجلس تكمن في تحسين أوضاع الأساتذة والمعلمين في لبنان. وأوضح أن الحكومة الجديدة، وخاصة بعد نيلها الثقة، يجب أن تبدأ بأعمالها التربوية وبتّ العديد من المراسيم المعلقة في مجلس الوزراء.
وينص قانون إنشاء صندوق التعويضات في المادة 43 منه على أن “مجلس الإشراف” على الصندوق يتم تعيينه بمرسوم صادر عن مجلس الوزراء، بناءً على اقتراح وزير التربية والتعليم العالي، لمدة ثلاث سنوات قابلة للتجديد. ويشرف المجلس على إدارة الصندوق ويقرر القضايا المتعلقة بتعويضات صرف الخدمة.
الجدير بالذكر أن الصندوق كان يتغذى من نسبة 6% من راتب أفراد الهيئة التعليمية و6% من مساهمة المدرسة. لكن هذه النسبة، وفق نصر، قد تحولت إلى 17 ضعفًا في الوقت الراهن.
وبناءً على ذلك، يعوّل الوفد التربوي على وعد رئيس الجمهورية للنهوض بالقطاع التعليمي وإعطاء الحقوق لأصحابها، مؤكدًا أن المرحلة الحالية هي مرحلة العمل الجاد، وأنهم يتطلعون إلى طرح مرسوم “مجلس الإشراف” أمام الحكومة الجديدة في أقرب فرصة.
“The Lebanese Government Has Not Decided on the Oversight Council for the Teachers' Compensation Fund: Why Is It Stuck?”
There are numerous educational demands that have been unresolved for years in Lebanon, mainly due to the ongoing crises that have left significant impacts on the educational sector. On Friday, a delegation from the Union of Private Educational Institutions, headed by Father Yusuf Nasr, the Secretary-General of Catholic Schools, visited Baabda Palace, where they met with President Joseph Aoun.
One of the most significant demands raised during this meeting was the Oversight Council for the Teachers' Compensation Fund in the private sector. This council has been stuck in the drawers of the Cabinet since it was proposed, with no final decision taken yet. What is this fund, and what is the role of the council? How does this affect the situation of teachers in Lebanon? And, why has this issue been stuck for so long?
Father Yusuf Nasr explained to “Al-Nahar” that the “Oversight Council”, or what is called the original administrative council, has been stuck in a decree before the Cabinet since February 2024. This means that an entire year has passed without a decision being made, which was a subject of discussion during the meeting with President Aoun.
Nasr pointed out that the previous government, led by Prime Minister Najib Mikati, had not decided on the decree for specific reasons, even though the former Minister of Education, Abbas Halabi, had presented the decree to the government and referred it for study. However, things remained at a standstill.
Nasr continued by saying that the current council overseeing the fund is essentially “inactive.” Decisions in this council can only be made by unanimous consent, but due to the continuous absence of several members, the council has been paralyzed since 2019. He emphasized the need to appoint an original administrative council or an oversight council to ensure that the natural process of work resumes.
Nasr confirmed that the educational delegation urged President Aoun to speed up the handling of this file, along with many other outstanding educational matters. He emphasized that the importance of this council lies in improving the conditions of teachers in Lebanon. He stated that the new government, especially after receiving confidence, should begin its educational tasks and address many of the pending decrees in the Cabinet.
According to the Law of the Compensation Fund, specifically in Article 43, it is stated that the “Oversight Council” for the fund is appointed by a decree issued by the Cabinet, based on a proposal from the Minister of Education and Higher Education, for a period of three years renewable. The council oversees the management of the fund and addresses issues related to service termination compensation.
It is noteworthy that the fund was originally fed by 6% of the salaries of the educational staff and 6% from the school's contribution. However, according to Nasr, this percentage has now increased to 17 times.
Given this, the educational delegation is relying on the promise of the President of the Republic to revive the educational sector and grant rights to those entitled. Nasr stressed that the current phase is a time for action and that they are looking forward to the decree of the “Oversight Council” being presented to the new government as soon as possible.
