في عام 2015، أُحيل القاضي نزيه ع. إلى التقاعد بعد بلوغه السن القانونية، وحصل على منصب شرفي برتبة رئيس مجلس عمل تحكيمي. لكن بعد مرور عشر سنوات على تقاعده، تكشفت فضيحة استمراره في الإشراف على أعمال مشروع الضم والفرز في إحدى بلدات قضاء زغرتا، رغم وجود قاضيين مكلفين رسميًا بهذه المهام في محافظة لبنان الشمالي.
تشير مراسلة صادرة في تموز 2023 إلى أن القاضي المتقاعد أبلغ بلدية مزيارة بأن “المستندات المتعلقة بأكثر من ألفي عقار قد نُظمت ووقّعت وأصبحت جاهزة للتوزيع على المالكين”. ولم تكن هذه المراسلة الوحيدة، إذ سبق أن أصدر عدة قرارات قضائية في 2022 تتعلق بأعمال ضم وفرز في محلة الميناء في طرابلس.
يعدّ هذا التصرف مخالفة قانونية جسيمة، بل جريمة يعاقب عليها القانون بتهمة انتحال صفة، وفقًا لمصادر مطلعة. وقد تحرك القضاء فور كشف الفضيحة، حيث استدعى القاضي المعني، وجرى استجوابه من قبل النائب العام التمييزي القاضي جمال الحجار، وقرّر تركه رهن التحقيق.

Judicial Investigation Launched Against Retired Judge for Illegal Oversight of Property Delimitation Projects Ten Years Post-Retirement
In 2015, Judge Nazih A. was retired upon reaching the legal retirement age and was granted an honorary position as Head of an Arbitration Council. However, a scandal surfaced revealing his continued supervision of property delimitation and subdivision projects in a town within the Zgharta district, despite two judges officially assigned to oversee such tasks in North Lebanon Governorate.
A correspondence dated July 2023 shows that the retired judge notified Mazra'a Municipality that “documents related to more than two thousand properties have been organized, signed, and are ready for distribution to owners.” This was not an isolated incident; he had previously issued several judicial decisions in 2022 concerning delimitation and subdivision work in the Mina area of Tripoli.
This conduct constitutes a serious legal violation and a punishable offense under the charge of impersonation, according to informed sources. Upon revealing the scandal, the judiciary promptly summoned the concerned judge. He was interrogated by the Prosecutor General Judge Jamal Al-Hajjar, who ordered that the judge be held under investigation.
Despite his attorney submitting a medical report indicating that the judge suffers from Parkinson’s disease, the case remains open for further judicial developments that could mark unprecedented proceedings in Lebanese courts.
